An owner appeals an inspector's order to the Superior Court of Justice. The same matter was also pending before the Building Code Commission. Which statement correctly describes the effect of launching the court appeal?
- The order is automatically suspended as soon as the appeal is launched, until the court decides it.
- The Building Code Commission proceeding continues in parallel with the appeal to the Superior Court of Justice, and both go ahead.
- The pending BCC proceeding is terminated, and the appeal does not stay the order, although a judge may stay it on just terms.
- The court must wait until the Building Code Commission has finished before it hears the appeal.
Why C. Launching the court appeal ends the Commission's proceeding on the same matter, and the appeal on its own does not stay the order, though a judge can stay it on just terms. Option A assumes an automatic stay the Act never grants. Options B and D both keep the Commission alive, one alongside the court and one ahead of it, and the section does the opposite: it shuts that proceeding down.

It is hard because the answers are scattered across an Act and three Divisions, and you have two and a half minutes to find each one.
The answer is rarely where you expect it
Permit refusal sits in the Act. The permit application requirements sit in Division C. The compliance obligation that ties them together sits in Division A. Candidates lose the clock moving between them rather than reading them.
The distinctions are fine and deliberate
An order to comply is not a stop work order. A ruling is not an alternative solution. The Building Code Commission does not hear what the Superior Court hears. The exam is built on exactly these boundaries, and a near miss scores zero.

Questions people ask before buying
Is this the same as the Designer Legal/Process exam?
No, they are separate examinations. General Legal/Process is the common legal exam most candidates sit. Designer Legal/Process is a designer specific variant, and we publish a bank for that one too, on its own page. Check which one your qualification category requires in the exam selection guide before you book.
How long should I prepare?
We don't publish an hours figure, because we don't have one. No two candidates arrive with the same familiarity with the Act, and we have no customer data to average. What we can describe is the shape of the work: topic practice until you land on the right provision without hunting for it, then timed simulations under the clock. Our readiness bar is every topic above 80% in practice and two consecutive timed simulations above 75%. Each result screen scores you by topic; the dashboard keeps your attempt count and your best score, so you'll want to note the topic figures as you go.
Did the 2024 code change this exam much?
The Act itself did not change, but Division C process content and article numbering did, and the compendium you navigate on exam day is the 2024 edition.
